It's not that Roger Clemens might have cheated. If he did cheat, he was just one of hundreds, and he's still a Hall of Famer in my book. It's not that if he did cheat, now he's lying about it. Most of us will dissemble about our misdeeds if we think there's a decent chance we won't get caught. It's not fair to expect our sports heroes to be articulate and emotionally mature. After all, nobody ever told Clemens to grow up. Why should he? Becoming articulate does take time, and it's not as if Clemens wasn't working hard at his craft all those years. It strikes me, though, that if the Rocket really does want to defend himself, change the minds of a lot of people, it sure would help if he'd learned at some point to come across as something other than a spoiled, petulant millionaire who thinks he did something for baseball. Rather than the other way around.

It better not have. Or Marion Jones won't be the only star athlete of the last decade looking at jail time. Clemens is the one who put himself into this box. Only the whole truth, and nothing but, sets him free.

I can't imagine how any lawyer would allow his client to go on '60 Minutes' and lie like that. This interview is going to cause him no end of troubles." You assume that Clemens will follow up and take every opportunity to say, again and again, that he did not use steroids. The defamation suit presumably will require him to sit through depositions, to answer questions from McNamee's lawyers as part of discovery. Perhaps a jury will decide, in the end, that it believes Clemens and give him a victory in a defamation suit. That won't change this fact: His name is part of the Mitchell report. We cannot be naïve; it may well be that everyone named within the report is guilty. But as a model for due process, the way the Mitchell investigation was conducted was horrific, something better suited for former Senator Joseph McCarthy than former Senator George Mitchell.

First they said if Clemens calls McNamee a liar and/or drug dealer they would sue for defamation. Clemens does both on 60 minutes. Now, McNamee's lawyer says they won't sue because Clemens didn't sound "believable" when he said those things. Translation: McNamee was full of crap when he said he'd sue for defamation. Clemens and his lawyers called him on it. McNamee backs down from threat.

Thus, McNamee got out of trouble by ratting him out initially, and now Rocket will save face a bit by suing for defamation. At the end of the day, all of this will shed some doubt on the Mitchell report which I'm sure McNamee wasn't gung ho about participating in from the get go. I'm sure there are a lot of backroom dealings in this to go along with the media posturing. -- Ross

None, not one iota. it is based largely on hearsay evidence and innuendo. George Mitchell is using his reputation to prop up his report but it is no better than one man's opinion. The very fact that Mitchell has a conflict of interest as a board member of the Red Sox, makes every single contention in his report highly suspect. The fact that Mr Mitchell has a legal Background and yet he still prepared this report despite its dubious flaunting of the Rules of Evidence and the principle of Impartiality is criminal in and of itself. If it were anyone but Mitchell, the report would be the very definition of Libel, Mitchell is trading on his reputation as a prosecutor and if the press were at all interested in truth, instead of selling papers or ratings, they would be asking questions of Mitchell. once again, The Mitchell Report is not based on any legal basis. None, not one iota. it is based largely on hearsay evidence and innuendo. This whole situation smacks of Nazi Germany of the late 30's, where fear and oppression over ran the rule of Law. George Mitchell is the criminal here, make no mistake about it. He knows the Law and yet he chose to produce a report that is not based on its precepts

They got pulled over by a cop, he found the gun and arrested both my brother and his friend... My brother had no clue the guy had a gun or even knew he had one. According to the Mitchell report Pettitte got his shots when he was in Florida rehabing, Clemens was no where near him at the time. Just because you're friends or family with someone doesnt mean you know every single thing that person is doing.

They said in the press conference that they hired 2 investigators to interview McNamee when they found out he talked to Mitchell, but he didnt tell the investigators what he said to Mitchell.

When Clemens claims to have no knowledge that Andy Pettitte - Clemens' close friend and training partner, and another former client of McNamee - had twice taken HGH, thus corroborating McNamee's testimony in the Mitchell Report, the trainer interjects, "I believe that." From Lawyer on Tubby's Blog... I mentioned in an earlier thread that it sounded to my trained ear that both sides knew they were being taped and that each side was tying to get the other to say something damaging. That's why neither side sounded natural and didn't come out and directly confront the other. McNamee was desperate to get Roger to say something along the lines of some kind of gift, money or a plane ticket, something. he kept playing the poverty card and saying "Tell me what you want me to do." Translation: "please tamper with me, offer me something or direct me to do something that helps you in some way." Roger was throwing in the lines from his script about "I don't understand why you did it. And somebody has to tell the truth," hoping McNamee would slip up. Before I end however, here's the $24,000 question: between Roger and McNamee, who used to earn his living making recording phone calls and face to face conversations with drug dealers and buyers? Uh, McNamee, the former NYPD NARC. Don't fall for his teary "sad dad with a sick kid" act. He's got ice water in his veins, people. Ward's explanation of why he says McNamee lied: "He lied to them and tried to say, 'Well, they pressured me,' because he wanted to continue to stay in the good graces of Roger," My Client oh yea he lied... "You have to figure that there was a Kirk Radomski in just about every clubhouse," a GM said the other day. "It wasn't only in New York." But so far, the fallout from the Mitchell report is generally confined to New York, where Radomski and Brian McNamee mostly worked. Some friends who are Yankees fans have believed all along in the conspiracy theory that New York got the most scrutiny because George Mitchell is on the board of directors of the Red Sox. That's way too Oliver Stone-ish for me. Mitchell's investigators didn't dig up McNamee and Radomski -- it was the feds who did that -- and beyond that, I just can't see Mitchell sitting in his office plotting to make life miserable for the Yankees. But the reality is that the Yankees are going to be knee-deep in this mess for months, and it could be an enormous distraction. Their No. 2 starter -- someone who was already on the fence about possibly retiring -- is going to spend a lot of the time usually reserved for preparation talking with lawyers. Assuming that Roger Clemens' defamation suit against McNamee goes forward, it figures that depositions will be taken from some executives and players of the Yankees, including Andy Pettitte. And as the revelations leak out from those depositions, inevitably, the Yankees will be caught in the wake of the headlines. It figures to be a long and ugly summer of steroid talk in New York, and much less so in Boston. The stakes just keep going up for McNamee, Clemens and Pettitte, with word that the congressional hearing scheduled for Jan. 16 has been postponed so that more information can be gathered, much of it in the form of depositions. There is no turning back now.
